Cash Back Rebate Terms and Requirements
Hot On Real Estate Services, LLC (hereafter referred to as "Broker")
Eligibility requirements for Buyer/program rules:
- You are at least 18 years old and interested in purchasing a new home.
- You will provide true and accurate information in my registration, including my name and valid email address, and will keep current the information during my new home search.
- You understand that in order to remain eligible for the Hot On! Cash Back Rebate, you must register Broker with the appropriate new home community sales office of that builder on YOUR FIRST VISIT to the community.
- You have not (i) signed a buyer representation agreement with another real estate broker, (ii) appointed any other real estate broker as my agent to buy a new home, and I will notify Broker in the event that I do.
- You are not a licensed real estate broker or real estate salesperson.
- You authorize Broker and any homebuilders for whom I register to contact me or my immediate family, using methods that include, but are not limited to, telephone, email, and US Mail. Such contact will be made using the information that I provide in my registration for the website.
- You understand that Broker disclaims all warranties and representations concerning the reliability and accuracy of the information displayed on the website in general, including warranties of merchantability or fitness for a particular purpose, and that information on the website is provided "as-is" and subject to change without notice.
- You acknowledge that Broker has advised me to verify and confirm independently the accuracy of the information displayed on the website.
- You agree that Broker shall not be liable to me for any claim or damages based on my use of the website or registration for the Hot On! Cash Back Rebate.
- You agree to look solely to the builder for payment or enforcement of any advertised discounts and incentives offered by a builder.
- You agree that by registering and accessing the information available to perform searches on the website, I have become a bona fide client of Broker seeking information about real estate services relating to my prospective purchase of a new home.
- After signing a sales contract, prospective Buyer must claim rebate by faxing the contract to Broker at Toll Free: 888-581-8845.
- Offer is not valid if prospective Buyer is accompanied to the Community by any real estate agent not affiliated with Broker during registration or contracting, or if prospective Buyer has previously registered at the Community with any real estate agent not affiliated with Broker.
- If you are currently working with any real estate agent not affiliated with Broker, please disregard this program, as it is not intended to be a solicitation to participate and you are not eligible.
- BROKER STRONGLY ENCOURAGES ALL PROSPECTIVE HOME PURCHASERS TO SEEK APPROPRIATE LEGAL COUNSEL FOR ALL ASPECTS OF A HOME PURCHASE TRANSACTION AS BROKER'S ROLE AND DUTIES IN THIS TRANSACTION IS LIMITED AS PROVIDED BY APPLICABLE TEXAS STATE LAW.
- Rebate from Broker is payable and due only if closing occurs on a new home purchased from the Builder after all terms, conditions and requirements of this program have been met and Broker receives its commission from the Builder.
- The Hot On! Cash Back rebate is 1% of the BASE selling price of the home as defined by the Builder. BASE selling price excludes options, upgrades and lot premiums. If the Builder makes adjustments to the base price that have the effect of lowering the selling price of the home, and/or reducing the price upon which it pays its cooperating broker commission, the Hot On! Cash Back rebate amount will be based on the lower of the base price or the adjusted price. If the Builder reduces its cooperating broker commission payment by deducting an administrative fee, the Hot On! Cash Back rebate amount will be reduced accordingly on a pro rata basis. Broker reserves the right to pay your rebate in an amount and in a form consistent with your initial registration on our website.
- Broker makes no representations regarding the tax treatment of the Hot On! Cash Back rebate. No taxes will be withheld from payment. Please consult your qualified tax advisor for more information.
- Broker makes no representations or warranties of any kind with respect to the Builder, the home constructed or to be constructed by Builder, the quality of construction, the value of the residence to be constructed by Builder, or except as provided by applicable Texas state law, the merchantability or fitness for any particular use of the improvements constructed or to be constructed on the Property, any other aspect of the real estate transaction between Builder and the Buyer, as such transaction is solely between the Buyer and Builder.
- Broker is not authorized to furnish Buyer legal advice or to interpret provisions in a sales contract. Buyer should consult an attorney of Buyer's choice to answer any questions pertaining to the Property.
- Broker will receive a "co-broker" commission from the Builder identified on the sales contract on the closing of the sale of any home purchased through the plan. A portion of this "co-broker" commission will be used to fund the Hot On! Cash Back rebate. Broker is a licensed Texas real estate broker.
- It is the Buyer's responsibility to disclose the Hot On! Cash Back rebate to his mortgage company representative at the earliest practicable date. Broker reserves the right to pay rebate to Buyer in the form of paying closing costs on the HUD-1 Settlement Statement in lieu of a direct cash payment to Buyer, if so required by the lender or other party to the sales contract, or in the form of a discount on the purchase price if so required by the Builder or lender, or, at Broker's sole discretion, in any other form based on the needs or requirements specific to the transaction. The rebate amount is based on Broker's receipt of a commission in an amount equal to at least 3.0% of the base sales price of the Property. If Broker's commission is less, the rebate amount will be reduced pro rata. Please see the Broker's Terms and Conditions for details.
- THE WEBSITE TERMS OF USE ARE HEREBY INCORPORATED IN THIS DOCUMENT AND THE INFORMATION CONTAINED IN THE WEBSITE AND THE USE THEREOF. THE TERMS OF ELIGIBILITY FOR PARTICIPANTS IN THE HOT ON! CASH BACK REBATE PROGRAM ARE EXPRESSLY SUBJECT TO THE TERMS, CONDITIONS, WAIVERS AND QUALIFICATIONS SET FORTH IN SUCH TERMS OF USE AND IN THE BUYER REPRESENTATION AGREEMENT.
- This program and offer are void where prohibited by law or lender.
